Michigan Insurance Department Withdraws Obsolete Bulletins

N/A'Annunzio, Acting Commissioner of Insurance for the state of Michigan has announced that the following bulletins have been withdrawn, together with any bulletins that they rescind, withdraw or supersede. Included in italic print is a brief explanation for their withdrawal.

75-13 ACCIDENT AND SICKNESS INSURANCE ADVERTISING (FILING FOR PRIOR REVIEW) This bulletin is obsolete. The referenced bulletin has been withdrawn. Accident and Sickness Insurance Advertising is covered in the Michigan Regulations.

78-22 LIFE AND ANNUITY CONTRACTS ON A VARIABLE BASIS. This bulletin is no longer necessary. It is a 20 year old announcement of a rules change and the subject matter should be common knowledge to insurers.

78-32 FOREIGN AND ALIEN INSURERS: APPLICATION FOR SURPLUS LINES APPROVAL. Printing forms in a bulletin format does not allow flexibility for changes; application forms are available by contacting the Insurer Licensing Division.

83-7 PRIVATE PASSENGER AUTOMOBILE AND HOME INSURANCE UNDERWRITING RULES. This bulletin is no longer necessary. It is informational and subject matter should now be common knowledge to those concerned.

83-8 APPLICATION FOR CERTIFICATE OF AUTHORITY AS A FOREIGN OR ALIEN INSURER: FORMS WITH INSTRUCTIONS - NOT REPRODUCED. This bulletin is obsolete. A new application for certificate of authority as a foreign or alien insurer has been developed and is available from the Insurer Licensing Division.

84-2 DISCLOSURE OF IDENTITY OF STOCKHOLDERS, OFFICERS, PARTNERS AND EMPLOYEES. This bulletin is obsolete. Certain items in the bulletin are inaccurate and all applicable information is contained in the Licensing Handbook - Bulletin 90-8.

84-5 APPLICATION TO INCORPORATE AND ORGANIZE A STOCK OR MUTUAL INSURER IN THE STATE OF MICHIGAN. This bulletin is obsolete. Certain items in the bulletin are inaccurate, a referenced rule has been rescinded, and the necessary forms are available from the Insurer Licensing Division.

85-1 REQUIREMENTS OF INSURERS AND THIRD PARTY ADMINISTRATORS ENTERING IN PRUDENT PURCHASER AGREEMENTS. This bulletin is obsolete. It is an announcement of what was then a new law and the referenced bulletin has been withdrawn.

85-3 PRIVATE PASSENGER AUTOMOBILE INSURANCE UNDERWRITING RULES PURSUANT TO CHAPTER 21 OF THE MICHIGAN INSURANCE CODE. This bulletin is no longer necessary. The applicable law has since been updated and is sufficient without this bulletin.

85-4 DETERMINATION OF AMOUNT OF LIABILITY FOR LIMITED PROPERTY DAMAGE CLAIMS. This bulletin is no longer necessary. The maximum amount of liability has changed. The referenced law and its application should be common knowledge to insurers.

85-7 WORKER'S COMPENSATION INSURANCE WRITTEN OVER QUALIFIED SELF-INSURANCE PLANS. This bulletin is obsolete. Some of the referenced bulletins have been withdrawn, and the applicable requirements regarding filing have changed.

85-9 PRIMA FACIE RATES FOR GROUP CREDIT LIFE INSURANCE. This bulletin is no longer necessary. Administrative Rules adequately cover the subject matter.

86-1 HOSPICE BENEFITS REQUIRED BY PUBLIC ACT 368 OF 1986. This bulletin is no longer necessary. It is merely an announcement of what was then a new law and its subject matter should be common knowledge to those concerned.

86-7 PRODUCT LIABILITY CLAIM REPORTS AND MOTORCYCLE LIABILITY AND FIRST-PARTY MEDICAL BENEFITS CLAIM REPORTS. This bulletin is no longer necessary. It is an announcement of a law change and its subject matter should be common knowledge to those concerned.

86-9 WORKERS' COMPENSATION DISABILITY ACT - AMENDMENTS OF 1985. This bulletin is no longer necessary. It is a one-time announcement of a law change and its subject matter should be common knowledge to those concerned.

87-4 USE OF LOW FIRST PREMIUMS FOR ACCIDENT AND HEALTH INSURANCE. This bulletin is no longer necessary. It is an explanation of a withdrawal of another bulletin.

87-6 EXCLUSION OF COVERAGE FOR PUNITIVE AND EXEMPLARY DAMAGES. This bulletin is no longer necessary. It is an explanation of a withdrawal of another bulletin.

89-6 WOOD BURNING STOVE RATING FACTOR IN HOME INSURANCE. This bulletin is no longer necessary. It explains the decision to allow what is now a standard rating criteria.

89-7 LICENSING PROCESS AND TESTING. This bulletin is obsolete. Certain parts of it are no longer accurate and all necessary information can be obtained from the Licensing Handbook - Bulletin 90-8.

90-1 FORMS WITH INSTRUCTIONS FOR RISK RETENTION GROUPS - PUBLIC ACT 214 OF 1989. Printing forms in a bulletin format does not allow flexibility for changes; forms are available by contacting the Insurer Licensing Division.

95-7 COPYRIGHT RESTRICTIONS ON INSURANCE BUREAU RECORDS. The Commissioner sought the formal opinion of the Attorney General on whether federal copyright law precludes this agency from making copies under the Michigan Freedom o Information Act of copyrighted materials. By Opinion No. 6965, issued January 16, 1998, the Attorney General concluded it does not. Therefore, this bulletin is withdrawn in reliance on that opinion.

The Michigan Insurance Department reminds insurers that the withdrawal of these bulletins does not change an insurer's responsibility to follow the provisions of the Insurance Code of 1956 and the Insurance Bureau Administrative Rules.
